Petraeus case shows ease of government email snooping

SAN FRANCISCO (Reuters) - The scandal surrounding the sudden resignation of an adulterous CIA director has stunned the American public not just for its prominent cast of characters, but also because of the ease with which authorities appeared to have traipsed through personal email accounts.

Technology has transformed communications much faster than the law, giving U.S. authorities at all levels the power to routinely search reams of intimate emails, texts and instant messages, with much lower burdens of proof as far as the relevance to a criminal case.

Often, the subjects of electronic searches never know that they've been hit, let alone why.

Recently, big tech companies including Google Inc and Facebook Inc are pushing back, refusing to disclose even old communications without a warrant and effectively daring the government to press its policy in court.

The issue has been thrust into the spotlight by the still-unfolding scandal that started with the revelation that General David Petraeus, while serving as CIA director, had an extramarital affair with his biographer, Paula Broadwell.

The relationship was discovered because Jill Kelley, a Tampa socialite and family friend of Petraeus, complained to the FBI's Tampa office about anonymous harassing emails.

Kelley herself didn't realize how badly an electronic inquiry could mushroom beyond control. She wrote an email on Wednesday to Tampa Bay's mayor that said her family had been "put through the ringer," in part because police released 911 phone call transcripts with her home address and cell phone number. That email, in turn, was among those released Friday after public-records requests to city hall from the media.

In the initial probe, the FBI was disturbed that Kelley's anonymous emailer had confidential information about Petraeus' whereabouts. It issued an administrative subpoena empowering agents to examine the email accounts from which the messages came, a law enforcement source told Reuters.

Investigators learned that the harassing messages were sent to Kelley by Broadwell. The FBI eventually got reams of emails, most likely with a warrant or the consent of the correspondents. The agency declined to comment.

In another twist, Marine General John Allen, commander of NATO and U.S. forces in Afghanistan, is now also under investigation for allegedly inappropriate communication with Kelley that was discovered during the course of the same FBI probe. Allen has denied that the two had a sexual relationship, officials said on condition of anonymity.

PUTTING LIVES ONLINE

Authorized snooping has quietly but rapidly reached an unprecedented level in the United States, and the disgrace of senior military officials not accused of any crime provides a rare opportunity to reflect on that transformation, privacy rights advocates said.

"If they subpoena you for your evidence, you can say `buzz off.' That's why all these are being served on third parties," said George Washington University law professor Orin Kerr, a former Justice Department trial attorney. "It's hidden information, and the service providers can comply cheaply and easily."

Subpoenas for business records have been commonplace for decades, but as individuals move more of their lives online, the services they adopt are subject to the same scrutiny.

"It has become so easy, the standard is so low, the delivery mechanism is so easy, that all the friction has been removed from the system and it now basically becomes a very standard investigative technique," said Jim Dempsey, vice president of the Center for Democracy & Technology, a nonprofit that gets funding from big technology companies.

The FBI, which has broad authority over cybercrimes from identity fraud to online stalking, can gather technical information about private citizens' email accounts with only a subpoena.

The subpoena in theory must not be overly burdensome on the recipient, but otherwise has few limits. Subpoenas can be drafted by a senior FBI agent or equivalent and do not require a judge's approval. They are common in grand jury investigations and other probes of crimes involving multiple parties.

The only potential hurdle comes when agents want the actual text contents of the emails.

Under the Justice Department interpretation of the Electronic Communications Privacy Act (ECPA), emails that are more than 180 days old are deemed "stored" and also can be turned over with just a subpoena.

The act was passed in pre-Web 1986, when electronic communications were rare and users often relied on bulletin-board services that deleted messages after users logged on and downloaded them.

The government argues that even much more recent undeleted emails -- those even sent the day prior -- are "stored" and fair game once they've been read. For years, law enforcement officials have had access to these too, with recipients often left in the dark.

Privacy groups, along with some technology companies that have long sought a rewrite of the ECPA, have contended that emails should not be subject to free-rein rummaging just because such third parties as Google, Microsoft Corp and Yahoo Inc are involved.

The 9th U.S. Circuit Court of Appeals, which covers California and other parts of the West, has agreed, saying that prosecutors need a probable-cause warrant for opened mail less than six months old.

The Ohio-based 6th Circuit went further, ruling in 2010 that much of ECPA conflicted with the Constitution's Fourth Amendment prohibition on unreasonable searches. That ruling is only binding in a handful of states.

Rather than appeal to the Supreme Court, law enforcement authorities have applied for more warrants but also have just sought out service providers in other jurisdictions.

To some extent, the big tech companies are fighting back.

The 6th Circuit ruling "reflects the right reading of the law and is the appropriate standard for protecting privacy of user-generated content," Facebook Chief Security Officer Joe Sullivan told Reuters.

He and a spokesman for Google said each company now demands a warrant for emails, even ones older than 180 days.

Google said this week it received requests by U.S. government entities for data on more than 16,000 users during the first six months of this year, up from 12,000 in the prior half-year, and at least partially complied with 90 percent of them.

That total includes warrants, subpoenas, criminal and intelligence wiretap orders and secret "national security letters," which have become much more common under the 2001 Patriot Act.

Purdue students concoct safe energy drink

A popular energy drink made here in Indiana is under scrutiny. The founder and CEO of 5-hour energy is strongly defending his product after claims that it led to 13 deaths in the past four years.

In the midst of this controversy, a group of Purdue students is doing their own testing and it all started in the dorms.

?We're full-time engineers, we're working to be entrepreneurs, we're juggling a few business ideas and on top of that we're college students,? said Andrew Linfoot, CEO and Co-founder of Kyk Energy. ?We like to go out and enjoy our lives, so we just really didn't sleep, at all.?

As if being engineering majors were not hard enough, Andrew Linfoot and his two partners are self-made food scientists and have very well become the most popular entrepreneurs at Purdue University.

?I mean, you only drink so many carbonated soda for breakfast,? Linfoot joked.? ?Our whole thing was we didn't like the taste of energy drinks.?

Two years later, Kyk Energy was born.? It's an energy supplement you can add to any drink without changing the taste. The chemists came up with the blend by breaking down the main ingredients found in popular energy drinks -- a mix of caffeine, amino acids, herbs and B-vitamins. And who better to test it on than sleep-deprived students?

?Everyone was all on board, they're hyped up, they knock on my door and are like, ?Andrew! I need the latest batch of Kyk! We?ve got a test coming up.??

Most people are concerned about how much caffeine is in energy drinks. To put it into perspective, a can of coke contains about 35 milligrams of caffeine. A Monster energy has about five times more with about 160 milligrams. A 5-hour energy is about 250 milligrams, which is nearly half of a Vente Starbucks coffee (400-500 milligrams).

Why won't insurance cover my lost frequent-flier miles?

Question: My wife used her Delta frequent flier miles for a trip to Manchester, England, to visit her mother. She bought trip insurance through Allianz. Two days before she was supposed to return, she called me to let me know she had been taken to the hospital with severe stomach pain.

She was diagnosed with a virus and given medication, but had to return to the hospital. I had to change her return date twice before she could make the flight home. Delta charged $253 and 20,000 miles to make the change.

My wife was diagnosed with a ruptured appendix and hospitalized immediately when she returned. Because of the amount of infection, removing the appendix was impossible and so she was put on antibiotics.

We made a claim with Allianz for the cost of changing her flight, but Allianz would only cover the $253. We?ve asked Delta to consider the circumstances that made this date change necessary and reimburse our frequent flier account with the 20,000 miles, but it won?t. Can you help? ? I think you might have avoided some of these problems by calling Allianz sooner. Many insurance companies also offer 24-hour emergency medical assistance services, and can help you find a hospital that can diagnose and treat your problem.

Allianz could have also advised you about your next steps and assisted your wife in getting home. (For example, even the basic Allianz policy covers you for up to $50,000 of an emergency medical transportation.)

A case like this underscores the need for reliable insurance while you?re traveling, if not through a travel insurance company, then through some other type of medical coverage. For example, a company like International SOS offers medical assistance, international health care and security services and could have given your wife a quick diagnosis and delivered her to a hospital with American standards.

Delta?s policy on redepositing miles is clear. According to the airline, Delta SkyMiles members who want to cancel or make changes to their wholly unused award ticket need to do so at least 72 hours before their original flight departure time to be eligible to redeposit unused award ticket miles or to reissue an award ticket.

I?ve seen Allianz cover miles on past claims, but before I approached the company, I decided to ask Delta to take another look at your wife?s case. It reviewed her request and decided to return the 20,000 miles as an exception.

    West Texas woman shows TCU students ladies can ranch as well as cowboys

    CHILDRESS, Texas -- Hollywood's version of ranching in Texas has almost always been off the mark -- not even close to what life is really like for people in agriculture.

    In West Texas, we came across a real-life John Wayne; just as tough, and just as committed to getting cattle to market and steaks to your table.

    But this one, like more ranchers than you might imagine, occasionally wears a dress.

    She knows every rancher's had a dream of country living, but higher prices and bad weather drove some off the land their family cherished.

    Like all of them, she?s been fighting to hold on to what she?s built up over time. The difference is, she's been very successful at it. So much so, that tomorrow's ranchers -- part of TCU?s Ranch Management program -- made the long drive to see her in West Texas, near Childress.

    When Minnie Lou Bradley and her late husband started Bradley 3 Ranch, Dwight Eisenhower was President. From that day to this, she has held the reins, and refused to give up.

    ?We can't shut the doors on Friday night [and] come back Monday morning, because our cattle got to be fed, horses got to be taken care of,? she said.

    At Bradley 3, they raise some of the world's finest Black Angus cattle. 57 years of careful breeding, culling, now has Minnie Lou's herd at the top of its game.

    So despite long hours and uncooperative weather, she's not going anywhere.

    ?I have city cousins,? she explained to News 8 one day sitting on her front porch surveying her property. ?They can't figure out why I like this old life. When I was younger, I'd go back to Fort Worth or some place, and they'd say you're darker in the winter time than you are in the summertime. I'd say it's just that old wind hittin' me horseback... That harsh wind. But I've outlived them all, so far."

    Minnie Lou and her family warn the TCU students that for them, it is simple: ?If you are not passionate about feeding people," her son-in-law, James Henderson, tells them, ?you shouldn?t come into our business.?

    However, more than endurance brings future ranchers to Bradley 3. Minnie Lou's techniques consistently outpace her competition.

    ?She is so innovative... When you get into an older generations, sometimes they don't want to change," said TCU student Jessen Tucker. "But they're experimenting with DNA testing and blood sampling."

    Over the years, countless other ranchers have followed the lead of the Bradley 3, even though a woman was at helm. While some women have experienced a sort of "grass ceiling" in ranching -- holding back advancement -- Minnie Lou said it doesn?t last.

    ?I think women own more land in the United States than men do today," she said. "'Course part of that is, we flat outlive 'em.?

    Now more women are joining Minnie Lou; six among the 28 from TCU this year. Some of whom, like Emma Mathis, still notice the occasional slight.

    ?There's even been people that are shocked to hear that women are in this, [and they say] 'Oh, so women actually want to be in the ranching industry?'? Mathis said.

    But their professor, Kerry Cornelius, makes it clear the women in this program can more than handle themselves on any ranch or farm.

    ?They're extremely bright, extremely knowledgeable," he said. "They can handle a horse, they can handle a rope, they can handle cattle, they can run the numbers, they can run the break even."

    As for the Bradley 3, Minnie Lou's successor's already in place: daughter Mary Lou Bradley Henderson. Just as tough as mom.

    ?Some days are just fun,? she explained to us, ?some days are just not so fun... It's just that here, you certainly can't control mother nature."

    Sitting in a chair that has been in the family for 100 years, Minnie Lou Bradley confesses that the years building Bradley 3 have weaved a bond between her and her ranch.

    ?When I sit in this chair, it does something to me, because I think of all the hardships they went through ranching in Texas,? Minnie Lou said.

    Now, with her legacy established, you couldn't blame her for sitting back and enjoying it all.

    However, no one expects that to happen. Not with horses needing care, cattle to get to market, and another tomorrow just beyond the horizon.

    At Washington's James Bond exhibit, villains are forever

    WASHINGTON (Reuters) - Fans of fictional super spy James Bond rely on the durable film franchise for must-have elements, such as jaw-dropping stunts, great clothes, sultry women - and villains who are drop-dead evil.

    An exhibition that opened on Friday makes clear that the nasty types that 007 has battled for five decades have changed but one constant remains. The only true match for the world's greatest secret agent are characters that moviegoers love to hate.

    "Exquisitely Evil: 50 Years of Bond Villains" at the International Spy Museum in downtown Washington, is dedicated to the most memorable bad guys and gals in the 23-film series.

    From the eponymous "Dr. No" in 1962 to the just-released "Skyfall," the exhibit shows links between fact and fiction and how villains have kept pace with an evolving world.

    "Bond seems the same, but the villains have all changed. They have changed to reflect the changing times," Anna Slafer, the museum's director of exhibitions, told a news conference.

    In "Dr. No," the villain schemes against the U.S. space program. Probing the nuclear fears of the 1970s, tycoon Karl Stromberg plots genocide in "The Spy Who Loved Me" (1977).

    The information age turns up with Max Zorin, who lusts to corner the microchip market in "A View to a Kill" (1985). In "Skyfall" cyberterrorist Silva tries to hack British intelligence computers.

    But some things have remained the same for the Bond villain, said Alexis Albion, a guest curator and intelligence historian.

    They are highly successful, often charming, live in isolated places, generate fanatical loyalty, and think big, she said. "They are on a level that we have to send someone like James Bond after them."

    They also "are off physically," Albion said. Le Chiffre in "Casino Royale" (2006) weeps blood, Dr. No has a magnetic claw in place of a hand, and the hitman Jaws in "The Spy Who Loved Me" and "Moonraker" (1979) is a giant with steel teeth.

    A galaxy of well-known actors - and a few actresses - from around the world have faced off against the six men who have played Bond, from Sean Connery to Daniel Craig.

    Yaphet Kotto, Max von Sydow, Sean Bean, Javier Bardem, Donald Pleasence, Christopher Lee, Michael Lonsdale, Lotte Lenya, Mads Mikkelsen, Jeroen Krabbe, Christopher Walken and Telly Savalas all have gone mano-a-mano with 007, and lost.

    The International Spy Museum's show was timed to the release of "Skyfall" and done in cooperation with EON Productions, which makes the Bond movies.

    The exhibit, which includes more than 110 movie and historical artifacts, including Jaws' teeth, interactive stations, and videos, runs through 2014. General admission to the museum is $19.95.

    (AP) ? A freight train slammed into a parade float carrying wounded veterans on Thursday, killing four people and injuring 17 others as the float tried to get through a West Texas railroad crossing on its way to an honorary banquet, authorities said.

    The train was sounding its horn and people were jumping off the decorated flatbed truck before the collision around 4:40 p.m. in Midland, according to witnesses and Union Pacific spokesman Tom Lange. A preliminary investigation indicates the crossing gate and lights were working, Lange said, though he didn't know if the train crew saw the float approaching.

    Two people died at the scene, while two others died at Midland Memorial Hospital, City of Midland spokesman Ryan Stout said. Six people remained hospitalized Thursday night, including at least one in critical condition; the other 11 people injured have been treated and released, hospital officials said.

    About two dozen veterans and their spouses had been sitting in chairs on the float, set up on the back of a flatbed tractor-trailer decorated with American flags and signs identifying each veteran. Many seemed to panic as the locomotive's horn sounded, said Patricia Howle, who was waiting in her car at a nearby traffic light as the train approached.

    "I was on the phone, and I just started screaming," she told The Associated Press late Thursday night. "The truck was on the other side of the train, but I did see the panic on the faces of the people and saw some of them jump off."

    The float was among two flatbed tractor-trailers carrying veterans and their spouses. Police said the first truck safely crossed the railroad tracks, but the second truck's trailer was still on the crossing as the train approached.

    "The train honked its horn, but the 18-wheeler could not go anywhere because of the other one being right in front of it," said Daniel Quinonez, who was in traffic that had been stopped by sheriff's deputies to allow the parade to pass.

    "It was a horrible accident to watch happen right in front of me. I just saw the people on the semi-truck's trailer panic, and many started to jump off the trailer. But it was too late for many of them because the train impacted the trailer so fast," he told the AP.

    Several police vehicles remained at the crash scene late Thursday night. Flood lights illuminated the wreck as investigators in reflective vests and hard hats carefully took measurements of the site, which was cordoned off by yellow police tape.

    The parade had been scheduled to end at a "Hunt for Heroes" banquet honoring the veterans. The wounded service members were then going to be treated to a deer-hunting trip this weekend. The events were canceled.

    The events were organized by Show Of Support, a local veterans group. Its president, Terry Johnson, did not immediately return an email for comment and his phone number was unlisted; the phone rang unanswered at the group's offices.

    Stout, also the police department's spokesman, said he had no information about the individuals who died or the driver of the truck.

    Lange said Union Pacific is offering help to the community and victims' families, as well as peer-to-peer counseling for the train crew, who did not sustain any injuries.

    "There is going to be a very thorough investigation," Lange said. "It's obviously a very tragic incident."

    The National Transportation Safety Board also is investigating, NTSB spokesman Peter Knudson said.

    Secretary of Defense Leon Panetta "was deeply saddened by news of the tragic accident involving veterans heroes and their spouses in Midland," Pentagon spokesman George Little said in a statement. "His thoughts and prayers are with the families of the victims, with those injured in this incident, and with the entire community."

    Midland is about 320 miles west of Dallas.

    France tells Germany it will slash deficit

    BERLIN (AP) ? France's prime minister assured Germany on Thursday that his country is committed to getting its debt under control, amid concerns that the second-largest economy in the eurozone is weakening.

    During his first visit to Berlin since taking office in May, Jean-Marc Ayrault sought to dispel fears that Germany's most important ally in fighting Europe's debt crisis could itself be heading for trouble just as the French government has to slash spending to reduce its deficit.

    France wants to "stop burdening future generations with continuously rising debt and restore the necessary leeway for political actions," Ayrault told a gathering of German business leaders. He stressed that "we are aware that getting the public finances in order is also the precondition for our sovereignty."

    Eurozone members Greece, Ireland and Portugal have all had to accept painful austerity demands in return for bailouts from the bloc's richer nations.

    According to official figures published Thursday, France narrowly dodged recession in the third quarter. Its economy expanded 0.2 percent in the July-September period from the previous quarter ? as did that of Germany, where growth is slowing.

    President Francois Hollande's Socialist government last week announced measures to rein in government spending, lower labor costs to strengthen the country's competitiveness and reduce the deficit, largely by raising taxes.

    "I wholeheartedly wish success to what is being set in motion in France now," German Chancellor Angela Merkel said following talks with Ayrault.

    "Our goal is to return to growth," Ayrault maintained.

    Still, France has watched unemployment tick steadily up as a raft of companies announced layoffs in recent months. The jobless rate now stands at 10.8 percent, according to European statistics.

    Thursday's edition of Britain's weekly The Economist featured a special report on France, with the magazine's cover reading "the time bomb at the heart of Europe." France's woes have also started to worry some in Germany, who fear their closest ally's political clout could be reduced by its economic weakness.

    "France is our closest partner in Europe. It would be good if the Socialists there would now courageously embark on real structural reforms," Volker Kauder, the parliamentary leader of Chancellor Angela Merkel's conservative bloc, said last week. "That would be good for the country and so for Europe."

    Speaking at the conference after Ayrault, the head of Germany's influential BDI industry lobby group insisted that both, Germany and France, must be economically strong to continue leading the European Union.

    "There is no Europe in which Germany and France do not play in the same league," said Hans-Peter Keitel. "You cannot separate us," added Keitel, who has met twice with Hollande this year.

    German Finance Minister Wolfgang Schaeuble, speaking at the same conference, said European nations who jointly make up the world's biggest economy should not give each other marks but work together.

    "The world needs a strong Europe," he said.

    Ayrault, in turn, said the "overly high level of preoccupation in Germany" over the euro crisis may be due to the fact that Germany will hold national elections next year. "Then tensions are always on the rise," he told German daily Sueddeutsche Zeitung in an interview.

    (AP) ? The debate over legalizing abortion in Ireland flared Wednesday after the government confirmed that a woman in the midst of a miscarriage was refused an abortion and died in an Irish hospital after suffering from blood poisoning.

    Prime Minister Enda Kenny said he was awaiting findings from three investigations into the death of Savita Halappanavar, a 31-year-old Indian woman who was 17 weeks pregnant. Her case highlighted the legal limbo in which pregnant women facing severe health problems can find themselves in predominantly Catholic Ireland.

    Ireland's constitution officially bans abortion, but a 1992 Supreme Court ruling found the procedure should be legalized for situations when the woman's life is at risk from continuing the pregnancy. Five governments since have refused to pass a law resolving the confusion, leaving Irish hospitals reluctant to terminate pregnancies except in the most obviously life-threatening circumstances.

    The vast bulk of Irish women wanting abortions, an estimated 4,000 per year, simply travel next door to England, where abortion has been legal on demand since 1967. But that option is difficult, if not impossible, for women in failing health.

    Halappanavar's husband, Praveen, said doctors at University Hospital Galway in western Ireland determined she was miscarrying within hours of her hospitalization for severe pain on Sunday, Oct. 21. He said over the next three days, doctors refused their requests for an abortion to combat her surging pain and fading health.

    The hospital declined to say whether doctors believed Halappanavar's blood poisoning could have been reversed had she received an abortion rather than waiting for the fetus to die on its own. In a statement, it described its own investigation into the death, and a parallel probe by the government's Health Service Executive, as "standard practice" whenever a pregnant woman dies in a hospital. The Galway coroner also planned a public inquest.

    "Savita was really in agony. She was very upset, but she accepted she was losing the baby," he told The Irish Times in a telephone interview from Belgaum, southwest India. "When the consultant came on the ward rounds on Monday morning, Savita asked if they could not save the baby, could they induce to end the pregnancy? The consultant said: 'As long as there is a fetal heartbeat, we can't do anything.'

    "Again on Tuesday morning ... the consultant said it was the law, that this is a Catholic country. Savita said: 'I am neither Irish nor Catholic' but they said there was nothing they could do," Praveen Halappanavar said.

    He said his wife vomited repeatedly and collapsed in a restroom that night, but doctors wouldn't terminate the fetus because its heart was still beating.

    The fetus died the following day and its remains were surgically removed. Within hours, Savita was placed under sedation in intensive care with blood poisoning and he was never able to speak with her again, her husband said. By Saturday, her heart, kidneys and liver had stopped working. She was pronounced dead early Sunday, Oct. 28.

    The couple had settled in 2008 in Galway, where Praveen Halappanavar works as an engineer at the medical devices manufacturer Boston Scientific. His wife was qualified as a dentist but had taken time off for her pregnancy. Her parents in India had just visited them in Galway and left the day before her hospitalization.

    Praveen Halappanavar said he took his wife's remains back to India for a Hindu funeral and cremation Nov. 3. News of the circumstances that led to her death emerged Tuesday in Galway after the Indian community canceled the city's annual Diwali festival. Savita Halappanavar had been one of the festival's main organizers.

    Opposition politicians appealed Wednesday for Kenny's government to introduce legislation immediately to make the 1992 Supreme Court judgment part of statutory law. Barring any such bill, the only legislation defining the illegality of abortion in Ireland dates to 1861, when the entire island was part of the United Kingdom. That British law, still valid here due to Irish inaction on the matter, states it is a crime punishable by life imprisonment to "procure a miscarriage."

    In the 1992 case, a 14-year-old girl identified in court only as "X'' successfully sued the government for the right to have an abortion in England. She had been raped by a neighbor. When her parents reported the crime to police, the attorney general ordered her not to travel abroad for an abortion, arguing this would violate Ireland's constitution.

    The Supreme Court ruled she should be permitted an abortion in Ireland, never mind England, because she was making credible threats to commit suicide if refused one. During the case, the girl reportedly suffered a miscarriage.

    Since then, Irish governments twice have sought public approval to legalize abortion in life-threatening circumstances ? but excluding a suicide threat as acceptable grounds. Both times voters rejected the proposed amendments.

    Legal and political analysts broadly agree that no Irish government since 1992 has needed public approval to pass a law that backs the Supreme Court ruling. They say governments have been reluctant to be seen legalizing even limited access to abortion in a country that is more than 80 percent Catholic.

    An abortions right group, Choice Ireland, said Halappanavar might not have died had any previous government legislated in line with the X judgment. Earlier this year, the government rejected an opposition bill to do this.

    "Today, some 20 years after the X case, we find ourselves asking the same question: If a woman is pregnant, her life in jeopardy, can she even establish whether she has a right to a termination here in Ireland?" said Choice Ireland spokeswoman Stephanie Lord.

    Coincidentally, the government said it received a long-awaited expert report Tuesday proposing possible changes to Irish abortion law shortly before news of Savita Halappanavar's death broke. The government commissioned the report two years ago after the European Court of Human Rights ruled that Ireland's inadequate access to abortions for life-threatening pregnancies violated European Union law.

    The World Health Organization, meanwhile, identifies Ireland as an unusually safe place to be pregnant. Its most recent report on global maternal death rates found that only three out of every 100,000 women die in childbirth in Ireland, compared with an average of 14 in Europe and North America, 190 in Asia and 590 in Africa.

    Art initiatives beyond physical spaces

    MANILA, Philippines - For the past 5 years, there has been a bloom of independent art initiatives in Manila.

    They have no physical spaces yet are introducing critical projects via the Internet and social networks, making use of our growing familiarity with Facebook, Twitter and the blogosphere.

    Funding for projects is now done through crowdfunding or crowdsourcing. One's own networks are utilized with the help of online payment methods like Amazon or Paypal that are accessible to anyone with Internet access.

    Technology-based initiatives (online and social media) endeavor to collect open-source information, organize discussions, solo art projects, curatorial projects and contemporary discussions in the midst of Manila's diverse political, cultural, social and economic orientations.

    They have learned to navigate past funding schemes through free resources online, mobilizing projects without and beyond physical spaces.

    Here are some of them:

    1) Generation Loss

    Initiated by video and new media curator Merv Espina, it is an ongoing series of dialogues, screenings and exhibitions that seek to posit parallel traditions and tendencies of experimental cinema and video.

    It programs exhibitions and artist talks and deals with contemporary artists working on video and technology-based projects regionally.

    3) Project Glocal

    It is a cross-cultural multi-local curatorial project initiatied by independent curator Dayang Yraola. It works on themes that are commonly associated with the "discourse of city" in Southeast Asia.

    The project reaches cities such as Bangkok, Singapore, Hong Kong and, of course, Manila. It attempts to instigate conversations relating to the glocal (defined as "thinking globally, acting locally" by Headhunt.com) as a social construct.

    It is an independent organization of young researchers and writers (recent graduates) who aim to document the recent history of Philippine contemporary art.

    In light of the fact that contemporary art discussion is being handled by particular "stakeholders" in the contemporary art community, DiscLab seeks to posit critical discussion of art by mapping art histories or engaging the market through questionnaires and interviews with more established art historians and critics.

    7) Planting Rice

    It is a contemporary art platform online that contains information on exhibitions, events and places as well as artists in Manila.

    The website is a resource of writings on current discussions and collaborations that are developing beyond available publications or mainstream spaces.

    It also features an archive of resources relevant to the present climate of cultural interchanges in contemporary art.

    Planting Rice also curates experimental or archival exhibitions relevant to the current art community.

    Findlay says father's battle with cancer putting triathlon year in perspective

    From a chronic injury, to a heartbreaking last-place performance at the London Olympics, to a diagnosis of anemia that knocked her out of the world championships, Paula Findlay has had one rough year.

    Then last week, the 23-year-old triathlete from Edmonton revealed on her blog that her dad Max is battling cancer.

    But rather than look at it as more horrible news in a what-else-can-go-wrong kind of season, Findlay said her dad's illness has helped her put everything in perspective.

    "As hard as I've had it this past year, I haven't had it that bad compared to a lot of people, with all the recent events that have happened, the hurricane in New York, and the Lance Armstrong situation and my dad being sick. . . there's lots of people who have had it a lot worse off than me," Findlay told The Canadian Press in a phone interview from California.

    The former world No. 1 triathlete came in last at the London Olympics, and the image of the sobbing redhead limping across the finish line will be one of the most enduring of the Games. Because of a hip injury that had plagued her for a year, she'd only had six solid weeks of training before London.

    After coming home, blood work showed she was anemic, forcing her to withdraw from the world championships in New Zealand.

    Last week, her dad underwent surgery for colon cancer.

    "I don't have any regrets about the past year, I'm very very lucky to have been a part of the Canadian Olympic team and it's a lot of hard work, but coming last at the Olympics is not the worst thing that can happen to you,"Findlay said.

    "Although it's disappointing and I put so much into it ? and that's the reason it's so disappointing ? learning from it and moving forward is important and I'm doing OK with that and having to put it in perspective for my dad has helped with that as well."

    Findlay said her "very stubborn and determined" dad is doing well. He was home from the hospital four days earlier than expected and is up and walking and eating solid food.

    In her recent blog entry ? "When the going gets rough" ? Findlay wrote "He's showed that optimism and positivity are powerful tools when the going gets rough."

    While her father recuperates, Findlay travelled to Morgan Hill, Calif., this week to be fitted with a new Specialized bike. Technicians gave her a bigger frame and adjusted the handle bars and pedals to help combat the hip injury that sidelined her for so much of last season.

    "You're pedalling so many revolutions, thousands and thousands of pedal strokes daily, so if you're a little bit off in your positioning or something is not quite right, it can make a huge difference over that many pedal strokes," Findlay explained. "Small changes you might not feel right away but over the long term and over hundreds and hundreds of rides and miles, it all adds up and your body can feel the impact of it if it's not quite right."

    Findlay also has a new coach in Joel Filliol, former coach of Olympic champion Simon Whitfield and former head coach of the British team.

    The two will be based out of Victoria, but will spend much of the winter doing warm-weather training in Arizona and Florida.

    Findlay said while it's not an overnight fix, she's getting a handle on the anemia that is common in female endurance athletes. She's monitoring her diet and taking supplements.

    "Although it's better now it's not fixed or anything," she said. "It's something I'll constantly need to monitor probably for the rest of my triathlon career."

    She's taking a patient approach to competing, saying she might not race again until April or May, or even as late as June. The focus for these next few months, she said, is getting strong and healthy, and rebuilding her confidence.

    She hopes to make a triumphant return to the London Olympic course next September for the ITU World Triathlon Series Grand Final, which she admits won't be easy after her experiences there.

    Findlay was touted as a Canadian medal hope for months leading into London, but many obviously were unaware of the severity of her injury.

    "But it was never a negative thing, it only became a little bit difficult when I was approaching the Olympics still not able to run and yet I was still on cereal boxes and on ads with the COC (Canadian Olympic Committee)," Findlay said. "But honestly it helped me get through it a little bit, it reminded me that I can do it and I had done it in the past and people believe in me. It was a constant reminder that I was on top and I could get back there."

    When she logged onto her Facebook account after the race, Findlay said she had hundreds of messages of support. She said she still gets comments from strangers.

    "It was surprising and unexpected," Findlay said. "I didn't want the sympathy, the 'Oh we're so proud of you, you're such an inspiration.' It's a little bit hard to respond to that because they don't see the behind-the-scenes work to get there.

    "They only see that two-hour race when I'm finishing in tears and might look like a hero but I certainly didn't feel like that, that's why I wasn't expecting the outpouring of support."

    The luxury yacht, commissioned by Steve Jobs, designed by Philippe Starck and constructed by 130-year-old Dutch Ship builder Feadship was recently launched.

    The original idea goes way back to 2007 when Jobs signed off on sketches by uber famous designer of all-things-cool Starck, on only his second draft. The yacht is at once very Starck and very Apple ? clean lines and slick functionality. However the name of 'Venus, which evokes flowery Baroque ornamentation sits a little uncomfortably with the intimidating utilitarian character of the hull. Perhaps 'iSail' might have been a better choice of name.

    Venus sits in the water in a very cool, determined manner, which is a departure from the current trend of sleek streamlining which dominates luxury yacht design. But Apple have always learned heavily on the German design purists' approach, most notably Dieter Rams, whose elegantly functional product design for Braun between the 60's and the 90's. The Venus is very much of the same school, austere, yet undeniable beautiful.

    This is neither a boat for ostentatious displays of wealth, or for those chasing a dream lifestyle, it's a creation tat would have suited Steve Jobs, who just didn't do things like other people, right down to the ground.     7 Reasons We're All Bridget Jones | YourTango

    Attention, Bridget Jones fans: We are v. excited that a new installment of our favorite awkward heroine is in the works! Helen Fielding has written another chapter in the life of the quirky Brit, and the book is scheduled for an autumn 2013 release.

    For the uninitiated, Bridget Jones Diary ? the tale of a desperate yet endearing everywoman and her clumsy and often hilarious pursuit of true love (or at least a good date) ??debuted in 1996 and quickly became and international bestseller and cultural phenom. Two movies followed, with Renee Zellweger as our quirky protagonist, and single 30-something women everywhere found a fumbling heroine they could finally relate too. It was in Bridget?s constantly adorable flaws ? namely her fixation on her body image, awkward approach to dating and penchant for wallowing in her misery (who can forget her onscreen rendition of 'All By Myself'?) that we wach saw a bit of ourselves. We are all Bridget Jones to some degree ? whether that makes us uncomfortable or not. Here are a few examples:?

    • We go for the sexy d-bag. It?s hard to not want to be with the hottest guy around. And when our crush actually shows an interest, the tempation to follow through can be irresistible ??despite the guy's less questionable reputation and aloof behavior. Bridget's obsession with Daniel Cleaver (played by Hugh Grant in the film) is perfect example of our tendence to torture ourselves with Mr. Wrong.
    • We fall down. Both literally and metaphorically, we all fall from grace. Whether it?s the result of a bottle of vodka or a heartbreak that is so devastating that our knees give out ? or, in Bridget's case, a very unfortunate bunny costume misunderstanding ? we?ve all found ourselves on the ground staring at the ceiling.
